Ilene H. Ferenczy, Esq., CPC, APA, is the managing member of Ferenczy Benefits Law Center LLP, a law firm with offices in Atlanta, Georgia and Knoxville, Tennessee, that specializes in employee benefits, including qualified pension and profit-sharing plans, executive compensation, and other benefits.

A member of the employee benefits community since 1977, Ms. Ferenczy holds the designations of Certified Pension Consultant from the American Society of Pension Professionals and Actuaries (ASPPA) and Accredited Pension Administrator from the National Institute of Pension Administrators (NIPA) and is a member of the American College of Employee Benefits Counsel. Ms. Ferenczy practiced for many years as a third-party administrator of qualified plans before becoming an attorney. Her expertise includes the design and implementation of retirement plans, advising clients on retirement plan issues in relation to mergers and acquisitions, representing companies and plans under audit by the various governmental agencies and resolving errors in a cost-effective manner, and consulting with clients regarding a myriad of planning, taxation, and fiduciary liability issues.

Ms. Ferenczy is a nationally known speaker and has authored more than 75 articles on qualified plan topics for national journals, including the J ournal of Taxation of Employee Benefits, the Journal of Mergers and Acquisitions, The ASPPA Journal, and the Journal of Pension Benefits . She is Co-Editor-in-Chief of the Journal of Pension Benefits. Ms. Ferenczy is also the author/compiler of three textbooks for ASPPA’s professional designation program and a former author of Wolters Kluwer’s Pension Termination Answer Book. The first female co-chair of ASPPA’s Government Affairs Committee, she helps oversee comment letters to the government organizations and lobbying efforts to Congress and the Administration in relation to benefits matters. She was a member of ASPPA’s Board of Directors and the 2007 recipient of ASPPA’s Educator of the Year Award.

Ms. Ferenczy is a past adjunct professor of employee benefits in the College of Law at Georgia State University in Atlanta, Georgia, and is on the Employee Benefits Advisory Board of the John Marshall Law School Center for Tax Law and Employee Benefits in Chicago, Illinois. She is a Fellow in the American College of Employee Benefits Counsel, the highest honor awarded to ERISA lawyers. Ms. Ferenczy is a magna cum laude graduate of UCLA, with a B.A. in History. She received two J.D. degrees, both summa cum laude, from Georgia State University College of Law and Western State University College of Law. She is admitted to practice law in Georgia and California and is a member of the Tax Section of the American, the Los Angeles County, and the Atlanta Bar Associations.

Adam is a partner and consultant at DWC ERISA Consultants, LLC. He works with business owners, executives and their other professional advisors on issues related to qualified retirement plans. His specialties include:

  • Customized plan design
  • Assessment of benefit programs in the context of mergers and acquisitions
  • Voluntary correction of plan errors via the IRS and DOL correction programs
  • Representation of clients in IRS and DOL examinations
  • Consultation with plan fiduciaries to assist in establishment and documentation of prudent processes

Adam is actively involved with the American Society of Pension Professionals and Actuaries ("ASPPA") where he serves on the Executive Committee, Board of Directors and the Government Affairs Committee. He is a past-president of the ASPPA Benefits Councils of Atlanta and New England. Adam also serves as vice-chair of the IRS Advisory Committee on Tax-Exempt and Government Entities ("ACT").

As a nationally recognized author and lecturer, Adam has been published in the Journal of Financial Services Professionals and The ASPPA Journal. He is co-editor of and a regular contributor to the Journal of Pension Benefits and is co-founder of Pension Pundits, LLC. Adam has spoken on retirement plan topics for a variety of organizations, provided testimony to the ERISA Advisory Council and co-authored several comment letters and proposals to the Treasury Department and Congress.

Adam holds the professional credentials of Qualified 401(k) Administrator (QKA), Qualified Pension Administrator (QPA) and Qualified Plan Financial Consultant (QPFC) from ASPPA as well as Registered Health Underwriter (RHU) and Registered Employee Benefits Consultant (REBC) from the American College. He is also enrolled to practice before the IRS as an Enrolled Retirement Plan Agent (ERPA).
